The website www.biorganic-natural.gr The website serves as the online store for showcasing and selling products via the internet of Boena Mevorah, who operates a sole proprietorship under the trade name “BIORGANIC” (hereinafter “Biorganic”), based in Greece, specifically in Thessaloniki, at 11 Georgiou Seferi Street, P.C. 54250, with VAT number 145984609 – Thessaloniki Tax Office Z’, contact phone +30 2310 318070, email: biorganic.natural@gmail.com.
The Terms governing the use of this website (www.biorganic-natural.gr) and the purchase of products through it, hereinafter referred to as the “Terms”, are defined by this document, as well as any other document referenced herein.
Before you start browsing our website, please review the Terms, which describe your rights and obligations, as well as the Privacy Policy, because by using this website or placing an order through it, you explicitly and unconditionally agree to and are bound by these Terms and the Privacy Policy. If you disagree with any of these Terms, please do not use the website.

1.Privacy Policy.

We place great importance on and fully respect the privacy and confidentiality of your personal data. We have designed the Privacy Policy to provide you with complete information regarding how your personal data is processed. These Terms explicitly incorporate the Privacy Policy. For details on how we process and protect your personal data, as well as information about cookies, please read the Privacy Policy in full. .

2.Information and Products.

• We are committed to the completeness and accuracy of the information provided on our website  www.biorganic-natural.gr, regarding the existence of the essential characteristics described for each product we offer, subject to possible technical or typographical errors that may have escaped attention or occurred inadvertently, or due to possible disruptions in the website's operation due to force majeure.
• We are not responsible for any discrepancies in color and/or design between the product displayed on the website and the one delivered to the customer.

3.Your obligations.

• You must always use our website and services in accordance with these Terms.
• By accepting these Terms, you declare that you are at least 18 years old and that you have the legal capacity to enter into binding contracts. If you are a minor, you are required to inform us that you have obtained the relevant parental consent and that you are able to provide us with your parents’ details as well as their written authorization.
• You undertake the obligation to use the website only for the submission of legitimate inquiries and/or orders, not to make false or fraudulent orders (otherwise, we have the right to cancel them and inform the relevant authorities), and to provide accurate and correct personal details required for the processing of your order, including your email address, mailing address, and/or other contact information, which you accept may be used by us to contact you if deemed necessary.
• You agree not to use the Biorganic website and online store to send, post, email, or transmit in any other way any content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, libelous, invades the privacy or confidentiality of a third party, shows bias, or expresses racial, national, or other discriminatory views, may cause harm to minors in any way, is not authorized for transmission under applicable law or contractual or managerial relationships (e.g., internal information, proprietary, and confidential information obtained or disclosed as part of employment relationships or covered by confidentiality agreements), infringes any patent, trademark, trade secret, copyright, or other proprietary rights of third parties, contains software viruses or any other codes, files, or programs designed to interrupt, damage, destroy, or limit the functionality of any computer software or hardware, willfully or unintentionally violates applicable Greek, EU, and international laws and regulations, may harass third parties in any way, or any content used for the collection or storage of personal data of other users. In case of non-compliance with these terms, we reserve the right to block your access to the website.
• You agree not to attempt unauthorized access to the website and its server, or to any other server, computer, and database connected to the website, and you undertake not to attack the website through a denial-of-service (DoS) attack or a distributed denial-of-service (DDoS) attack. A violation of this obligation may constitute a criminal offense under applicable law. Any such violation will be reported to the relevant law enforcement authorities. Similarly, in the event of such a violation, we will immediately suspend your right to use this website.
• It is strictly prohibited for you or any third party to use any robot, spider, site search application, retrieval tool, or any other device to copy, retrieve, archive, or index any part of the website that requires authentication.
• Any action that may affect the smooth operation of the website, as well as the ability of other users to access and use the website and its services, is generally prohibited.

4.Service Availability.

The products sold through the Biorganic online store are available in Greece and abroad.

5.Registration capability on the website.

• Wholesale food professionals can make purchases through our online store by registering on our website.
• To register on our website, you need to enter your email address and your Tax Identification Number (TIN). Then, a security code (password) will be sent to your email. You have the option to change the security code by clicking on the link included in the email sent to you.

6.User Authentication.

• In the case of registration on our website, the credentials used for your authentication are two: a) the username or email address, and b) the personal secret security code (password).
• You are given the ability to change your personal secret security code (password) and your email address at any time. Your personal details are accessible by you through these credentials, and you are solely responsible for maintaining their confidentiality and protecting them from third parties. In case of loss or leakage, you must immediately notify Biorganic; otherwise, our online store is not liable for the use of the secret code by unauthorized individuals.
• For security reasons, we advise you to change your password at regular intervals and to avoid using the same and easily guessable passwords (e.g., birth date). Additionally, we recommend using not only letters and numbers but also symbols when creating your password.

7.Formation of the contract.

• The information contained in these Terms and the details provided on this website do not constitute an offer for sale, but an invitation for information. No contract will be deemed to have been formed between us regarding any products, except when your order is explicitly accepted by us. If we do not accept your order and the payment has already been deducted from your account, it will be fully refunded.
• To place an order, follow the steps in the relevant form. You will then receive an automated email from Biorganic confirming the receipt of your order. From this point, a contract is formed between us. The contract will only apply to the products for which we have confirmed your order. We are not obligated to supply any additional products that may be part of your order, unless the order for these products is confirmed with a separate Order Confirmation. Finally, you will receive an email confirming the delivery of the product to the courier company.
• In case there is any pending issue with your order, an email will be sent to you. Alternatively, we will contact you at the phone numbers you provided during registration or when placing your order on our website.
• These notifications cannot be disabled, as sending them is a requirement for the proper processing of your order. We ask that you ensure these emails can reach you and that you keep them throughout the course of our transaction. If you do not receive the relevant emails, you are obligated, according to the terms governing our transactions, to inform us without delay.

8.Product Availability.

All product orders are subject to their availability. In case of supply difficulties or stock shortages, we reserve the right to inform you about similar products of equal or higher quality and value that you may order. If you do not wish to proceed with any order, we will refund the full amount you may have paid.

9.Order Rejection

• We reserve the right to withdraw any product from this website at any time and/or to remove or modify any material or content on this website, without being liable to you or any third party.
• Although we make every effort to process all orders submitted to us, exceptional circumstances may arise under which we may need to reject an order, which we can do at any time at our sole discretion, without any liability to you or any third party. In this case, you may request a credit for the amount paid for future purchases or a refund.
• We reserve the right to reject an order if the user has previously canceled two (2) orders and to proceed with blocking the user from using the online store of the website.

10.Order Cancellation.

Your order can be canceled in the following cases:
a) Before completing the order, during the online process, you can remove the quantities of products from your cart by clicking the 'remove' button.
b) If the online order has been completed, you can contact us via email at the following address: biorganic.natural@gmail.com or call us at +30 2310 318070. One of our representatives will assist you promptly and inform you of all your options. The shipping costs for returning the product are the responsibility of the customer. For applicable charges, please refer to term 13.4.

11.Price.

• The price of each product is the one stated on our website at any given time, except in cases of obvious error.
• We reserve the right to unilaterally modify the prices of our products without any prior notice. It is clarified that changes in product prices do not apply to orders that you have already placed. We bear no liability towards you or any third party for any modification of prices.
• The prices on our website are in EUR and do not include VAT until the products are added to the shopping cart, at which point VAT is calculated accordingly (as applicable in Greece). Shipping costs, if any, are not included.
• Any currency conversion fees and other charges related to payments are borne exclusively by you and are added to the product price.

12.Payment Methods.

α) Bank deposit / bank transfer:
By selecting bank deposit / bank transfer as the payment method, Biorganic’s bank account number will be communicated to you via email.

β) Cash on Delivery.
By selecting cash on delivery as the payment method, you pay our partner upon delivery of your order to your premises.
Cash on delivery fee: €2.

γ) Payment via IRIS:
Log in to your e-banking account and make a transfer via IRIS to VAT number 145984609. Enter the amount and click next. The name “Mevorah Boena” will appear, and you complete the transfer.

δ) Payment via credit or debit card:
Our online store accepts all Visa and Mastercard credit/debit cards. We use Piraeus Bank as our payment service provider, and you will be automatically redirected to its transaction environment. Payment processing is subject to the terms, conditions, and privacy policy of Piraeus Bank http://www.piraeus-sec.gr/otherpages/politiki-aporitou . We do not control and are not responsible for the security or performance of Piraeus Bank’s system. Under no circumstances do we have access to your banking data.

13.Product Delivery – Shipping Costs.

• Subject to the provisions of Clause 8 regarding product availability and unless exceptional circumstances apply, we will make every effort to complete your order.
• Delays may occur depending on the delivery area, customs checks, unforeseen circumstances (e.g., extreme weather, strikes, force majeure events), or when it is impossible to contact you by phone and/or email (if an issue arises with your order, whether related to the product or its payment), for example, because the information you provided is not correctly updated.
• If for any reason we fail to meet the delivery date due solely to our own fault, we will inform you and offer you the option to either proceed with the purchase by setting a new delivery date on our part, or to cancel the order with a full refund.
• Shipping costs for the product are borne by the customer and are determined as follows:

CENTRAL MAKEDONIA

• FREE delivery with our vehicle for any order, provided there is a scheduled company route.
• Courier: Cost to be arranged in consultation with the shipping company we recommend or the one you use.
• Free shipping for orders over €80 on courier deliveries.

REST OF GREECE

• Courier: Cost to be arranged in consultation with the shipping company we recommend or the one you use.

CYPRUS

• Courier: Cost to be arranged in consultation with the shipping company we recommend or the one you work with.

The estimated delivery times from the courier company are:

Within Greece: 1–2 days
– Islands: 1–3 days
– Remote areas: 1–5 days
Europe: 5–7 days
International: 6–8 days

14.Transfer of Risk and Ownership of Products.

Responsibility for the products passes to you once you, or a third party designated by you other than the carrier, have taken physical possession or control of the products. Ownership of the products transfers to you either upon our full receipt of all amounts due in relation to the products, including any applicable shipping costs, or upon delivery if it occurs after the payment has been received.

15.Right of Withdrawal.

• For purchases made remotely (e.g., via the Internet), you have the right to withdraw from the contract without giving any reason within fourteen (14) calendar days from the day you, or a third party designated by you other than the carrier, acquired physical possession or control of the products.
• In order to lawfully exercise the right of withdrawal, you are required, before the withdrawal period expires, to:
a) either send an email to biorganic.natural@gmail.com
, or use our contact form, explicitly expressing your decision to withdraw from this contract, and
b) return the product to us in its original, perfect condition in which it was delivered, or provide clear and indisputable evidence that you have safely sent it back, within fourteen (14) calendar days from the day you received it.
• Please return the products in their original, perfect condition (as new), without making any modifications, additions, or other alterations, using or including their original packaging, instructions, and any other accompanying documents; otherwise, you are not entitled to withdraw. In any case, the products you wish to return must be accompanied by the necessary legal documents and proof of receipt.
• Within fourteen (14) working days from the receipt of the product, and provided we have verified its excellent condition, we are obliged to refund any amounts you have paid, via a bank transfer to an account of which you are the rightful owner. For your convenience, and to avoid additional bank charges, we recommend that the accounts you provide belong to Piraeus Bank or Eurobank.
• The customer is liable for any reduction in the value of the goods only as a result of handling the goods in a way other than what is necessary to establish their nature, characteristics, and functionality. We are not liable and will not compensate the consumer, nor will the withdrawal have effect, in cases where the goods have been damaged due to the customer’s fault or used beyond what is necessary to establish their nature, characteristics, and functionality.
• You are not entitled to withdraw in any case provided by law or by this agreement in accordance with Greek law.
• The shipping costs for returning the product are borne by the customer. For the applicable charges, see Clause 13.4.

• Returns are not accepted for products from the previous company’s dealership.

16.Returns of Defective Products.

• If you believe that the product you ordered does not comply with the terms of the contract at the time of delivery, you must contact us within fourteen (14) days of receiving it, either by sending an email to biorganic.natural@gmail.com
or through our online contact form, providing a detailed description of the product and its defect, and explicitly stating whether you wish to have it replaced or refunded.
• After we carefully examine the returned product, we will inform you via email within a reasonable time regarding your request. The replacement of the product or the refund will be carried out as soon as possible and, in any case, within five (5) working days from the day we confirm via email that you are entitled to a refund or replacement of the defective product. In the case of defective products, the amount paid will be fully refunded, including any shipping costs you may have incurred for returning the product. The refund will be made via a bank transfer to an account of which you are the rightful owner.
• Replacement can only be made with a product of the same code and subject to availability. If the product you wish for is not available, we will contact you to offer additional options. In any case, a refund is possible.
• A refund cannot be made to a third party/recipient to whom we delivered the product at your direction.
• In the event that you send us a product that has been damaged or has decreased in value due to your fault, or if you exercise your right late, we will withhold the payment, return the product to you, and the shipping costs will be borne by you.

17.Product Replacement.

• You have the option to request a replacement of the product you purchased within three (3) days of receiving it.
• We can replace the product you purchased with the same product or with a different product.
•Replacement can only be made if the requested product is available. If the product you want is not available, we will contact you to offer additional options. In any case, a refund is possible.
• The shipping costs for the new product are borne by the customer.

18.Product Returns.

• Για τις επιστροφές προϊόντων εντός Ελλάδας, παρακαλούμε αυτές να πραγματοποιούνται με την εταιρεία της ACS Courier.
• Για τις επιστροφές προϊόντων από το εξωτερικό, παρακαλούμε αυτές να γίνονται με την υπηρεσία συστημένου δέματος του ταχυδρομείου, ώστε να διασφαλίζεται η μεταφορά των προϊόντων.
• Όλες οι επιστροφές πρέπει να πραγματοποιούνται στην εξής διεύθυνση: Biorganic, Γεωργίου Σεφέρη 11, Τ.Κ. 54250, Χαριλάου – Θεσσαλονίκη, Ελλάδα.
• Παρακαλούμε να διατηρείτε τις αποδείξεις της εταιρείας ταχυμεταφορών ή του ταχυδρομείου έως ότου ολοκληρωθεί η μεταξύ μας συναλλαγή.

19.Τα δικαιώματά μας.

Διατηρούμε το δικαίωμα να αρνηθούμε οποτεδήποτε την παροχή των υπηρεσιών και την πώληση των προϊόντων μας σε οποιονδήποτε και για κάθε λόγο.

20.Δικαιώματα πνευματικής ιδιοκτησίας.

• Όλο το περιεχόμενο των αναρτώμενων ιστοσελίδων, συμπεριλαμβανομένων, ενδεικτικά και όχι περιοριστικά, εικόνων, φωτογραφιών, γραφικών, κειμένων, διαθέσιμων υπηρεσιών και προϊόντων κλπ αποτελούν πνευματική ιδιοκτησία της Biorganic και προστατεύονται από τις σχετικές διατάξεις του ελληνικού και του ευρωπαϊκού δικαίου, καθώς και των διεθνών συμβάσεων. Τα ονόματα, εικόνες, λογότυπα και διακριτικά γνωρίσματα που αντιπροσωπεύουν την Biorganic ή/και τρίτους είναι αποκλειστικά εμπορικά σήματα και διακριτικά γνωρίσματα της Biorganic ή/και των τρίτων και προστατεύονται από τους ελληνικούς, κοινοτικούς και διεθνείς νόμους περί εμπορικών σημάτων, βιομηχανικής και πνευματικής ιδιοκτησίας και αθέμιτου ανταγωνισμού.
• Απαγορεύεται: α) να τροποποιείτε, να μεταφράζετε, να δημιουργείτε ή να επιχειρείτε να δημιουργήσετε παράγωγα αντίγραφα ή αντίγραφο του λογισμικού ή του δικτυακού τόπου, είτε στο σύνολο είτε σε μέρος του, β) η αποσυμπίληση (decompilation), η αποσυναρμολόγηση, η μετατροπή του τελικού κώδικα (object code) σε πηγαίο κώδικα (source code), γ) να διανείμετε, εκχωρήσετε, διαμοιράσετε, χρονομισθώσετε, δανείσετε, πωλήσετε, εκμισθώσετε ή μεταβιβάσετε με οποιονδήποτε άλλο τρόπο το λογισμικό ή την ιστοσελίδα προς όφελός σας.
• Δεν επιτρέπεται σε καμία περίπτωση και με οποιονδήποτε τρόπο, η αναπαραγωγή, αναδιανομή, αντιγραφή, αναδιαμόρφωση, τροποποίηση, αποκάλυψη, διανομή, αναδημοσίευση, λήψη, εμφάνιση, λήψεις στιγμιότυπων, μεταφόρτωση ή η μετάδοση του υλικού που διατίθεται στην ιστοσελίδα, ούτε η πώληση ή εκχώρηση της χρήσης της ιστοσελίδας, χωρίς την προηγούμενη ρητή και έγγραφη συγκατάθεση της Biorganic. Αυτό δεν εμποδίζει τους χρήστες να χρησιμοποιούν την παρούσα ιστοσελίδα στο βαθμό που απαιτείται για τη δημιουργία ενός αντιγράφου μιας παραγγελίας ή των στοιχείων της σύμβασης.
• Αναγνωρίζετε και συμφωνείτε ότι οι πληροφορίες τρίτων που τυχόν παρουσιάζονται σε εσάς μέσω της ιστοσελίδας προστατεύονται από πνευματικά δικαιώματα, εμπορικά σήματα, σήματα υπηρεσιών, διπλώματα ευρεσιτεχνίας ή άλλα ιδιοκτησιακά δικαιώματα και νόμους. Η χρήση από εσάς λογισμικού τρίτου μέρους ή περιεχομένου που λαμβάνεται μέσω της Biorganic δεν μεταφέρει σε εσάς δικαιώματα, τίτλους ή συμφέροντα. Επιπλέον, συμφωνείτε ότι δεν θα χρησιμοποιείτε κανένα λογισμικό ή περιεχόμενο τρίτων που διατίθενται σε εσάς μέσω της ιστοσελίδας εκτός από τις περιπτώσεις που επιτρέπεται ρητά βάσει των όρων χρήσης ή της άδειας χρήσης του τρίτου μέρους. Εάν δεν συμφωνείτε με τους όρους χρήσης ή τη συμφωνία άδειας χρήσης τρίτων μερών, μην κάνετε λήψη ή χρήση του λογισμικού ή του περιεχομένου τρίτου μέρους.
• Σε περίπτωση παραβίασης των όρων σχετικά με την πνευματική ιδιοκτησία, θα πρέπει να διαγράψετε αμέσως οποιοδήποτε υλικό αποκτήθηκε παρανόμως.

21.Πλατφόρμες κοινωνικής δικτύωσης.

Διατηρούμε επίσης παρουσία σε πλατφόρμες κοινωνικής δικτύωσης όπως το Facebook και το Instagram. Οποιεσδήποτε υπηρεσίες προσφέρουμε μέσα από τις πλατφόρμες κοινωνικής δικτύωσης καθώς και όλες οι πληροφορίες που κοινοποιούνται, υποβάλλονται ή προσφέρονται από αυτήν μέσω των λογαριασμών μας στα social media, υπόκεινται στους παρόντες Όρους, εκτός και εάν, ρητώς και εγγράφως, συμφωνηθεί άλλως.

22.Σύνδεσμοι στην ιστοσελίδα.

Η ιστοσελίδα μας ενδέχεται να περιέχει συνδέσμους (links) προς άλλες ιστοσελίδες και πηγές που παρέχονται από τρίτους, αποκλειστικά για ενημερωτικό σκοπό. Το περιεχόμενο των εν λόγω ιστοσελίδων ή πηγών δεν βρίσκεται σε καμία περίπτωση υπό τον έλεγχό μας και, ως εκ τούτου, δεν φέρουμε καμία απολύτως ευθύνη για οποιαδήποτε απώλεια ή ζημία που ενδεχομένως προκληθεί από τη χρήση των εν λόγω συνδέσμων.

23.Έγγραφη επικοινωνία.

Η ισχύουσα νομοθεσία απαιτεί ορισμένες από τις πληροφορίες ή ενημερώσεις που σας αποστέλλουμε να έχουν έγγραφη μορφή. Όταν χρησιμοποιείτε την ιστοσελίδα μας, αποδέχεστε ότι η επικοινωνία μαζί μας θα γίνεται κυρίως με ηλεκτρονική μορφή. Θα επικοινωνούμε μαζί σας μέσω email ή θα σας παρέχουμε πληροφορίες αναρτώντας ανακοινώσεις στην ιστοσελίδα μας. 24.Ενημερωτικά emails (Newsletters).

• Ανά τακτά χρονικά διαστήματα αποστέλλουμε ενημερωτικά emails. Η ενημέρωση πραγματοποιείται μόνο εφόσον εσείς το επιλέξετε και για όσο χρόνο επιθυμείτε.
• Για την επιτυχή παράδοση των newsletters ουδεμία ευθύνη φέρουμε, αν και καταβάλλεται κάθε δυνατή προσπάθεια με τους ISP’s (Internet Service Providers).
• Τα newsletters ενδέχεται να καταλήξουν στο φάκελο ανεπιθύμητης αλληλογραφίας (spam folder), οπότε παρακαλούμε να ελέγχετε τακτικά ότι δεν αποθηκεύονται εκεί.
• Εάν δεν επιθυμείτε να λαμβάνετε πλέον ενημερωτικά emails, μπορείτε να διαγραφείτε από τη λίστα επιλέγοντας το σχετικό σύνδεσμο που περιέχεται στο newsletter.

25.Περιορισμός υποχρεώσεων και ευθύνης.

• Η ευθύνη μας σε σχέση με οποιοδήποτε προϊόν αγοράζει ο χρήστης/πελάτης από την ιστοσελίδα μας περιορίζεται στο ποσό της τιμής αγοράς του συγκεκριμένου προϊόντος, εκτός αν ρητά ορίζεται άλλως στους Όρους αυτούς.
• Δεν φέρουμε καμία ευθύνη έναντι σας ή έναντι οποιουδήποτε τρίτου για οποιαδήποτε τροποποίηση στις υπηρεσίες ή/και τις τιμές.
• Σε περίπτωση που δεν είστε νόμιμος κάτοχος της πιστωτικής / χρεωστικής / προπληρωμένης ή άλλου είδους κάρτας που χρησιμοποιείτε για την αγορά προϊόντων από το ηλεκτρονικό μας κατάστημα, ουδεμία ευθύνη φέρουμε έναντι του νόμιμου κατόχου της πιστωτικής / χρεωστικής / προπληρωμένης ή άλλου τύπου κάρτας που χρησιμοποιήθηκε για οποιαδήποτε συναλλαγή με την ιστοσελίδα μας. Εάν αποκαλυφθεί η παράνομη συμπεριφορά σας, η συνδρομή σας και οι παρεχόμενες από εμάς υπηρεσίες θα διακόπτονται αμέσως και χωρίς προειδοποίηση, διατηρουμένων των νομίμων δικαιωμάτων μας σε αυτήν την περίπτωση.
• Συμφωνείτε ότι είστε αποκλειστικά υπεύθυνοι για όλες τις χρεώσεις που τυχόν υπάρχουν για την πρόσβαση και χρήση της ιστοσελίδας.
• Δεν εγγυόμαστε ότι οι υπηρεσίες μας θα παρέχονται χωρίς διακοπή, θα είναι ασφαλείς ή δίχως καθυστερήσεις ή σφάλματα. Το περιεχόμενο της ιστοσελίδας ενδέχεται να περιέχει ανακρίβειες και τυπογραφικά λάθη για τα οποία δεν φέρουμε καμία ευθύνη.

• Δεν φέρουμε ευθύνη έναντι των χρηστών, των συνεργατών ή / και οποιουδήποτε τρίτου έλκει δικαιώματα από αυτούς, για οποιαδήποτε απώλεια ή ζημία (άμεση, έμμεση, αποθετική, οικονομικής ή άλλης φύσης) οφειλόμενη σε: α) τυχόν τεχνικά προβλήματα που ενδεχομένως παρουσιασθούν στους χρήστες όταν επιχειρούν την πρόσβαση στον δικτυακό μας τόπο και κατά τη διάρκεια αυτής και έχουν σχέση με τη λειτουργία ή τη συμβατότητα της δικής τους υποδομής με τη χρήση του δικτυακού τόπου, β) τυχόν τεχνικά προβλήματα ή δυσλειτουργίες των Internet Service Providers, γ) επίθεση άρνησης εξυπηρέτησης, ιούς ή άλλου είδους κακόβουλο λογισμικό ή τεχνολογικά επιβλαβές υλικό το οποίο μπορεί να προσβάλει τον υπολογιστή του χρήστη, τα εξαρτήματά του, τα δεδομένα ή κάθε άλλο υλικό του εξαιτίας της χρήσης της παρούσας ιστοσελίδας ή της τηλεφόρτωσης υλικού που περιέχεται σε αυτή ή ανάλογου υλικού άλλου ιστότοπου στον οποίο παραπέμπει η παρούσα ιστοσελίδα και εν γένει για πράξεις ή παραλείψεις τρίτων και ιδιαίτερα μη επιτρεπόμενες παρεμβάσεις τρίτων σε προϊόντα ή/και υπηρεσίες ή/και πληροφορίες που διατίθενται μέσω αυτού, δ) γεγονότα ανωτέρας βίας, και ε) παραβίαση της κείμενης νομοθεσίας (λ.χ. φορολογικής, προστασίας προσωπικών δεδομένων, πνευματικής ιδιοκτησίας κλπ), που σχετίζεται με τη χρήση της ιστοσελίδας μας.

26.Γεγονότα ανωτέρας βίας.

• Η Biorganic δεν καθίσταται υπόλογη ή υπεύθυνη για οποιαδήποτε αδυναμία εκπλήρωσης ή καθυστέρηση στην εκπλήρωση οποιωνδήποτε εκ των υποχρεώσεών της βάσει μιας σύμβασης, η οποία έχει προκληθεί από γεγονότα ανωτέρας βίας.
• Ως γεγονός ανωτέρας βίας θεωρείται κάθε πράξη, γεγονός, αδυναμία πραγματοποίησης, παράλειψη ή ατύχημα που δεν υπόκειται στον εύλογο έλεγχό μας και περιλαμβάνει ενδεικτικά τα εξής: α. Απεργίες, ανταπεργίες ή άλλες συνδικαλιστικές δράσεις, β. Κοινωνική αναταραχή, εξέγερση, εισβολή, τρομοκρατική επίθεση ή απειλή τρομοκρατικής επίθεσης, πόλεμο (είτε έχει κηρυχθεί είτε όχι) ή απειλή ή προετοιμασία για πόλεμο, γ. Πυρκαγιά, έκρηξη, καταιγίδα, πλημμύρα, σεισμό, καθίζηση, επιδημία ή άλλη φυσική καταστροφή, δ. Αδυναμία χρήσης των σιδηροδρόμων, πλοίων, αεροπλάνων, μηχανοκίνητων οχημάτων ή άλλων δημόσιων ή ιδιωτικών μέσων μεταφοράς, ε. Αδυναμία χρήσης των δημόσιων ή ιδιωτικών τηλεπικοινωνιακών δικτύων, στ. Πράξεις, διατάγματα, νόμοι, κανονισμοί ή κυβερνητικοί περιορισμοί, ζ. Κάθε απεργία, βλάβη ή ατύχημα των ακτοπλοϊκών και ταχυδρομικών υπηρεσιών ή των λοιπών μέσων μεταφοράς.
• Η εκπλήρωση των υποχρεώσεών μας από οποιαδήποτε σύμβαση θεωρείται ότι αναστέλλεται για την περίοδο που διαρκεί το γεγονός ανωτέρας βίας και ο χρόνος για την εκπλήρωση των υποχρεώσεών μας θα παρατείνεται για χρονικό διάστημα ίσο με τη διάρκεια της εν λόγω περιόδου. Θα καταβάλλουμε κάθε εύλογη προσπάθεια για να λήξει το γεγονός ανωτέρας βίας ή να βρούμε λύση με την οποία να καθίσταται δυνατή η εκπλήρωση των υποχρεώσεών μας βάσει της σύμβασης παρά το γεγονός ανωτέρας βίας.
• Ουδεμία ευθύνη φέρουμε για προϊόντα μας τα οποία αγοράζονται από φυσικά καταστήματα και όχι από το ηλεκτρονικό μας κατάστημα.

27.Μεταβίβαση δικαιωμάτων και υποχρεώσεων.

Η σύμβαση ανάμεσα σε εσάς και εμάς είναι δεσμευτική για αμφότερους όσο και για τους αντίστοιχους δικαιοδόχους και εκδοχείς μας. Δεν επιτρέπεται να μεταβιβάσετε, εκχωρήσετε ή διαθέσετε με άλλο τρόπο μια σύμβαση, ή οποιαδήποτε από τα δικαιώματα ή τις υποχρεώσεις σας που απορρέουν από αυτήν, χωρίς την προηγούμενη γραπτή συγκατάθεσή μας. Διατηρούμε το δικαίωμα να μεταβιβάσουμε, εκχωρήσουμε, αναθέσουμε με υπεργολαβία ή διαθέσουμε με άλλο τρόπο μια σύμβαση, ή οποιοδήποτε από τα δικαιώματα ή τις υποχρεώσεις μας που απορρέουν από αυτήν, ανά πάσα στιγμή κατά τη διάρκεια ισχύος της σύμβασης. Προς αποφυγή αμφιβολιών, κάθε τέτοια μεταβίβαση, εκχώρηση ή άλλου τύπου διάθεση δεν θίγει τα νόμιμα δικαιώματά σας ως καταναλωτή ούτε ακυρώνει, μειώνει ή με άλλο τρόπο περιορίζει οποιαδήποτε ρητή ή σιωπηρή εγγύηση που ενδέχεται να σας έχουμε παράσχει.

28.Αποζημίωση.

Συμφωνείτε να αναλάβετε την ευθύνη σε περίπτωση που ασκηθεί εναντίον της Biorganic οποιαδήποτε αξίωση ή απαίτηση από οποιονδήποτε τρίτο, καθώς και να την αποζημιώσετε για οποιαδήποτε έξοδα ή απώλειες, συμπεριλαμβανομένων εύλογων νομικών αμοιβών (συμπεριλαμβανομένων, ενδεικτικά, αμοιβών δικηγόρων), τα οποία προκύπτουν από: α) τη χρήση της ιστοσελίδας μας, β) την ανταλλαγή οποιουδήποτε περιεχομένου που προκύπτει από τη χρήση της ιστοσελίδας σε οποιοδήποτε τρίτο μέρος, γ) τη χρήση οποιουδήποτε περιεχομένου κατεβάσετε από την ιστοσελίδα μας στον υπολογιστή ή / και τους διακομιστές σας από εσάς και κάθε άλλο πρόσωπο στο οποίο παρέχονται οι πληροφορίες, δ) παραβίαση των παρόντων Όρων, ε) πληροφορίες που έχετε στείλει, υποβάλει, παραλάβει ηλεκτρονικά, προβάλει, εκτυπώσει, μεταφορτώσει ή μεταδώσει μέσω της ιστοσελίδας ή στ) την παραβίαση των δικαιωμάτων οποιουδήποτε άλλου ατόμου ή οντότητας. Είστε υπεύθυνοι για τις ενέργειές σας όταν χρησιμοποιείτε την ιστοσελίδα μας, συμπεριλαμβανομένων, μεταξύ άλλων, των δαπανών που προκύπτουν για την πρόσβαση στο Διαδίκτυο. Σε κάθε περίπτωση, η Biorganic θα έχει το δικαίωμα να επιλέξει τον δικό της νομικό σύμβουλο.

29.Πρόσθετοι όροι.

• Η αποτυχία μας να εφαρμόσουμε οποιαδήποτε διάταξη των Όρων αυτών δεν αποτελεί παραίτηση από το δικαίωμά μας να το πράξουμε αργότερα.
• Εάν κάποια διάταξη των παρόντων Όρων κριθεί ανεφάρμοστη, θα αντικατασταθεί με νέα, ενώ οι λοιπές διατάξεις θα παραμείνουν σε πλήρη ισχύ.
• Οι παρόντες Όροι διατυπώθηκαν πρωτοτύπως στην ελληνική γλώσσα και ενδέχεται να μεταφραστούν σε άλλες γλώσσες. Σε περίπτωση σύγκρουσης μεταξύ της μεταφρασμένης έκδοσης και της πρωτότυπης ελληνικής, η ελληνική υπερισχύει.
• Οι παρόντες Όροι δεν ισχύουν για την αγορά των προϊόντων μας από φυσικά καταστήματα. Τα εν λόγω καταστήματα δεν συνδέονται με το ηλεκτρονικό μας κατάστημα και εφαρμόζουν διαφορετικούς όρους και πολιτικές.

30.Τροποποίηση Όρων.

• Οι παρόντες Όροι, μαζί με κάθε άλλο ρητά αναφερόμενο σε αυτούς έγγραφο, αποτελούν την πλήρη συμφωνία μεταξύ της Biorganic και των χρηστών αναφορικά με το αντικείμενο της κάθε σύμβασης, αντικαθιστώντας κάθε προηγούμενη γραπτή ή προφορική συμφωνία, συνεννόηση ή διακανονισμό μεταξύ μας.
• Διατηρούμε το δικαίωμα μονομερούς τροποποίησης, ανανέωσης ή κατάργησης οποιουδήποτε όρου περιέχεται στους παρόντες Όρους, οποτεδήποτε και χωρίς προηγούμενη ειδοποίηση των χρηστών.
• Οι χρήστες θα ενημερώνονται σχετικά με τυχόν τροποποιήσεις και αλλαγές, μέσω της ιστοσελίδας του παρόντος ηλεκτρονικού καταστήματος ή όπως απαιτείται διαφορετικά από το νόμο. Διευκρινίζεται ότι η αλλαγή των Όρων δεν καταλαμβάνει παραγγελίες στις οποίες έχετε ήδη προβεί.
• Διευκρινίζεται ότι κάθε τυχόν τροποποίηση των Όρων δεν θα ισχύει αναδρομικά αλλά από την ημερομηνία ανάρτησής τους στην ιστοσελίδα. Συνεχίζοντας να χρησιμοποιείτε την ιστοσελίδα μετά τη θέση σε ισχύ οποιασδήποτε τροποποίησης, συμφωνείτε ότι δεσμεύεστε από τους νέους Όρους. Εάν διαφωνείτε με τις αλλαγές μπορείτε να μην χρησιμοποιείτε την ιστοσελίδα.
• Είναι δική σας ευθύνη να διαβάζετε τους Όρους και την Πολιτική Απορρήτου ανά τακτά χρονικά διαστήματα, καθώς οι Όροι και η Πολιτική που βρίσκονται σε ισχύ κατά το χρόνο που κάνετε χρήση της ιστοσελίδας ή καταρτίζεται η σύμβαση είναι και οι εφαρμοστέοι.

31.Εφαρμοστέο δίκαιο και δικαιοδοσία.

Η χρήση της ιστοσελίδας μας καθώς και οι συμβάσεις για την αγορά προϊόντων μέσω αυτής διέπονται αποκλειστικά από το ελληνικό δίκαιο.
Κάθε διαφορά που προκύπτει από ή σχετίζεται με τη χρήση της ιστοσελίδας ή τις εν λόγω συμβάσεις, υπόκειται στην αποκλειστική δικαιοδοσία των ελληνικών δικαστηρίων και συγκεκριμένα, αυτών της Θεσσαλονίκης.
