The Terms governing the use of this website (www.biorganic-natural.gr) and the purchase of products through it, hereinafter referred to as the “Terms”, are defined by this document, as well as any other document referenced herein.
Before you start browsing our website, please review the Terms, which describe your rights and obligations, as well as the Privacy Policy, because by using this website or placing an order through it, you explicitly and unconditionally agree to and are bound by these Terms and the Privacy Policy. If you disagree with any of these Terms, please do not use the website.

2.Information and Products.
• We are committed to the completeness and accuracy of the information provided on our website www.biorganic-natural.gr, regarding the existence of the essential characteristics described for each product we offer, subject to possible technical or typographical errors that may have escaped attention or occurred inadvertently, or due to possible disruptions in the website's operation due to force majeure.
• We are not responsible for any discrepancies in color and/or design between the product displayed on the website and the one delivered to the customer.
3.Your obligations.
• You must always use our website and services in accordance with these Terms.
• By accepting these Terms, you declare that you are at least 18 years old and that you have the legal capacity to enter into binding contracts. If you are a minor, you are required to inform us that you have obtained the relevant parental consent and that you are able to provide us with your parents’ details as well as their written authorization.
• You undertake the obligation to use the website only for the submission of legitimate inquiries and/or orders, not to make false or fraudulent orders (otherwise, we have the right to cancel them and inform the relevant authorities), and to provide accurate and correct personal details required for the processing of your order, including your email address, mailing address, and/or other contact information, which you accept may be used by us to contact you if deemed necessary.
• You agree not to use the Biorganic website and online store to send, post, email, or transmit in any other way any content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, libelous, invades the privacy or confidentiality of a third party, shows bias, or expresses racial, national, or other discriminatory views, may cause harm to minors in any way, is not authorized for transmission under applicable law or contractual or managerial relationships (e.g., internal information, proprietary, and confidential information obtained or disclosed as part of employment relationships or covered by confidentiality agreements), infringes any patent, trademark, trade secret, copyright, or other proprietary rights of third parties, contains software viruses or any other codes, files, or programs designed to interrupt, damage, destroy, or limit the functionality of any computer software or hardware, willfully or unintentionally violates applicable Greek, EU, and international laws and regulations, may harass third parties in any way, or any content used for the collection or storage of personal data of other users. In case of non-compliance with these terms, we reserve the right to block your access to the website.
• You agree not to attempt unauthorized access to the website and its server, or to any other server, computer, and database connected to the website, and you undertake not to attack the website through a denial-of-service (DoS) attack or a distributed denial-of-service (DDoS) attack. A violation of this obligation may constitute a criminal offense under applicable law. Any such violation will be reported to the relevant law enforcement authorities. Similarly, in the event of such a violation, we will immediately suspend your right to use this website.
• It is strictly prohibited for you or any third party to use any robot, spider, site search application, retrieval tool, or any other device to copy, retrieve, archive, or index any part of the website that requires authentication.
• Any action that may affect the smooth operation of the website, as well as the ability of other users to access and use the website and its services, is generally prohibited.
4.Service Availability.
The products sold through the Biorganic online store are available in Greece and abroad.
5.Registration capability on the website.
• Wholesale food professionals can make purchases through our online store by registering on our website.
• To register on our website, you need to enter your email address and your Tax Identification Number (TIN). Then, a security code (password) will be sent to your email. You have the option to change the security code by clicking on the link included in the email sent to you.
6.User Authentication.
• In the case of registration on our website, the credentials used for your authentication are two: a) the username or email address, and b) the personal secret security code (password).
• You are given the ability to change your personal secret security code (password) and your email address at any time. Your personal details are accessible by you through these credentials, and you are solely responsible for maintaining their confidentiality and protecting them from third parties. In case of loss or leakage, you must immediately notify Biorganic; otherwise, our online store is not liable for the use of the secret code by unauthorized individuals.
• For security reasons, we advise you to change your password at regular intervals and to avoid using the same and easily guessable passwords (e.g., birth date). Additionally, we recommend using not only letters and numbers but also symbols when creating your password.
7.Formation of the contract.
• The information contained in these Terms and the details provided on this website do not constitute an offer for sale, but an invitation for information. No contract will be deemed to have been formed between us regarding any products, except when your order is explicitly accepted by us. If we do not accept your order and the payment has already been deducted from your account, it will be fully refunded.
• To place an order, follow the steps in the relevant form. You will then receive an automated email from Biorganic confirming the receipt of your order. From this point, a contract is formed between us. The contract will only apply to the products for which we have confirmed your order. We are not obligated to supply any additional products that may be part of your order, unless the order for these products is confirmed with a separate Order Confirmation. Finally, you will receive an email confirming the delivery of the product to the courier company.
• In case there is any pending issue with your order, an email will be sent to you. Alternatively, we will contact you at the phone numbers you provided during registration or when placing your order on our website.
• These notifications cannot be disabled, as sending them is a requirement for the proper processing of your order. We ask that you ensure these emails can reach you and that you keep them throughout the course of our transaction. If you do not receive the relevant emails, you are obligated, according to the terms governing our transactions, to inform us without delay.
8.Product Availability.
All product orders are subject to their availability. In case of supply difficulties or stock shortages, we reserve the right to inform you about similar products of equal or higher quality and value that you may order. If you do not wish to proceed with any order, we will refund the full amount you may have paid.
9.Order Rejection
• We reserve the right to withdraw any product from this website at any time and/or to remove or modify any material or content on this website, without being liable to you or any third party.
• Although we make every effort to process all orders submitted to us, exceptional circumstances may arise under which we may need to reject an order, which we can do at any time at our sole discretion, without any liability to you or any third party. In this case, you may request a credit for the amount paid for future purchases or a refund.
• We reserve the right to reject an order if the user has previously canceled two (2) orders and to proceed with blocking the user from using the online store of the website.
10.Order Cancellation.
Your order can be canceled in the following cases:
a) Before completing the order, during the online process, you can remove the quantities of products from your cart by clicking the 'remove' button.
b) If the online order has been completed, you can contact us via email at the following address: biorganic.natural@gmail.com or call us at +30 2310 318070. One of our representatives will assist you promptly and inform you of all your options. The shipping costs for returning the product are the responsibility of the customer. For applicable charges, please refer to term 13.4.
11.Price.
• The price of each product is the one stated on our website at any given time, except in cases of obvious error.
• We reserve the right to unilaterally modify the prices of our products without any prior notice. It is clarified that changes in product prices do not apply to orders that you have already placed. We bear no liability towards you or any third party for any modification of prices.
• The prices on our website are in EUR and do not include VAT until the products are added to the shopping cart, at which point VAT is calculated accordingly (as applicable in Greece). Shipping costs, if any, are not included.
• Any currency conversion fees and other charges related to payments are borne exclusively by you and are added to the product price.
12.Payment Methods.
α) Bank deposit / bank transfer:
By selecting bank deposit / bank transfer as the payment method, Biorganic’s bank account number will be communicated to you via email.
β) Cash on Delivery.
By selecting cash on delivery as the payment method, you pay our partner upon delivery of your order to your premises.
Cash on delivery fee: €2.
γ) Payment via IRIS:
Log in to your e-banking account and make a transfer via IRIS to VAT number 145984609. Enter the amount and click next. The name “Mevorah Boena” will appear, and you complete the transfer.
δ) Payment via credit or debit card:
Our online store accepts all Visa and Mastercard credit/debit cards. We use Piraeus Bank as our payment service provider, and you will be automatically redirected to its transaction environment. Payment processing is subject to the terms, conditions, and privacy policy of Piraeus Bank http://www.piraeus-sec.gr/otherpages/politiki-aporitou . We do not control and are not responsible for the security or performance of Piraeus Bank’s system. Under no circumstances do we have access to your banking data.
13.Product Delivery – Shipping Costs.
• Subject to the provisions of Clause 8 regarding product availability and unless exceptional circumstances apply, we will make every effort to complete your order.
• Delays may occur depending on the delivery area, customs checks, unforeseen circumstances (e.g., extreme weather, strikes, force majeure events), or when it is impossible to contact you by phone and/or email (if an issue arises with your order, whether related to the product or its payment), for example, because the information you provided is not correctly updated.
• If for any reason we fail to meet the delivery date due solely to our own fault, we will inform you and offer you the option to either proceed with the purchase by setting a new delivery date on our part, or to cancel the order with a full refund.
• Shipping costs for the product are borne by the customer and are determined as follows:
CENTRAL MAKEDONIA
- FREE delivery with our vehicle for any order, provided there is a scheduled company route.
- Courier: Cost to be arranged in consultation with the shipping company we recommend or the one you use.
- Free shipping for orders over €80 on courier deliveries.
REST OF GREECE
- Courier: Cost to be arranged in consultation with the shipping company we recommend or the one you use.
CYPRUS
- Courier: Cost to be arranged in consultation with the shipping company we recommend or the one you work with.
The estimated delivery times from the courier company are:
Within Greece: 1–2 days
– Islands: 1–3 days
– Remote areas: 1–5 days
Europe: 5–7 days
International: 6–8 days
14.Transfer of Risk and Ownership of Products.
Responsibility for the products passes to you once you, or a third party designated by you other than the carrier, have taken physical possession or control of the products. Ownership of the products transfers to you either upon our full receipt of all amounts due in relation to the products, including any applicable shipping costs, or upon delivery if it occurs after the payment has been received.
15.Right of Withdrawal.
• For purchases made remotely (e.g., via the Internet), you have the right to withdraw from the contract without giving any reason within fourteen (14) calendar days from the day you, or a third party designated by you other than the carrier, acquired physical possession or control of the products.
• In order to lawfully exercise the right of withdrawal, you are required, before the withdrawal period expires, to:
a) either send an email to biorganic.natural@gmail.com
, or use our contact form, explicitly expressing your decision to withdraw from this contract, and
b) return the product to us in its original, perfect condition in which it was delivered, or provide clear and indisputable evidence that you have safely sent it back, within fourteen (14) calendar days from the day you received it.
• Please return the products in their original, perfect condition (as new), without making any modifications, additions, or other alterations, using or including their original packaging, instructions, and any other accompanying documents; otherwise, you are not entitled to withdraw. In any case, the products you wish to return must be accompanied by the necessary legal documents and proof of receipt.
• Within fourteen (14) working days from the receipt of the product, and provided we have verified its excellent condition, we are obliged to refund any amounts you have paid, via a bank transfer to an account of which you are the rightful owner. For your convenience, and to avoid additional bank charges, we recommend that the accounts you provide belong to Piraeus Bank or Eurobank.
• The customer is liable for any reduction in the value of the goods only as a result of handling the goods in a way other than what is necessary to establish their nature, characteristics, and functionality. We are not liable and will not compensate the consumer, nor will the withdrawal have effect, in cases where the goods have been damaged due to the customer’s fault or used beyond what is necessary to establish their nature, characteristics, and functionality.
• You are not entitled to withdraw in any case provided by law or by this agreement in accordance with Greek law.
• The shipping costs for returning the product are borne by the customer. For the applicable charges, see Clause 13.4.
• Returns are not accepted for products from the previous company’s dealership.
16.Returns of Defective Products.
• If you believe that the product you ordered does not comply with the terms of the contract at the time of delivery, you must contact us within fourteen (14) days of receiving it, either by sending an email to biorganic.natural@gmail.com
or through our online contact form, providing a detailed description of the product and its defect, and explicitly stating whether you wish to have it replaced or refunded.
• After we carefully examine the returned product, we will inform you via email within a reasonable time regarding your request. The replacement of the product or the refund will be carried out as soon as possible and, in any case, within five (5) working days from the day we confirm via email that you are entitled to a refund or replacement of the defective product. In the case of defective products, the amount paid will be fully refunded, including any shipping costs you may have incurred for returning the product. The refund will be made via a bank transfer to an account of which you are the rightful owner.
• Replacement can only be made with a product of the same code and subject to availability. If the product you wish for is not available, we will contact you to offer additional options. In any case, a refund is possible.
• A refund cannot be made to a third party/recipient to whom we delivered the product at your direction.
• In the event that you send us a product that has been damaged or has decreased in value due to your fault, or if you exercise your right late, we will withhold the payment, return the product to you, and the shipping costs will be borne by you.
17.Product Replacement.
• You have the option to request a replacement of the product you purchased within three (3) days of receiving it.
• We can replace the product you purchased with the same product or with a different product.
•Replacement can only be made if the requested product is available. If the product you want is not available, we will contact you to offer additional options. In any case, a refund is possible.
• The shipping costs for the new product are borne by the customer.
18.Product Returns.
• For product returns within Greece, please use ACS Courier.
• For product returns from abroad, please use the registered parcel service of the postal service, in order to ensure the safe transport of the products.
• All returns must be sent to the following address: Biorganic, 11 Georgiou Seferi Street, Postal Code 54250, Charilaou – Thessaloniki, Greece.
• Please keep the receipts from the courier company or the postal service until our transaction has been completed.
19.Our Rights.
We reserve the right to refuse the provision of our services and the sale of our products to anyone at any time and for any reason.
20.Intellectual Property Rights.
• All content of the published webpages, including indicatively and not limited to images, photographs, graphics, texts, available services and products, etc., constitutes the intellectual property of Biorganic and is protected by the relevant provisions of Greek and European law, as well as international conventions. The names, images, logos, and distinctive features representing Biorganic and/or third parties are exclusive trademarks and distinctive signs of Biorganic and/or such third parties and are protected by Greek, EU, and international laws on trademarks, industrial and intellectual property, and unfair competition.
• It is prohibited to:
a) modify, translate, create, or attempt to create derivative works or copies of the software or the website, in whole or in part;
b) decompile, disassemble, or convert object code into source code;
c) distribute, assign, share, lease, rent, lend, sell, sublicense, or otherwise transfer the software or the website in any manner for your own benefit.

Under no circumstances and in any manner whatsoever is the reproduction, redistribution, copying, reformatting, modification, disclosure, distribution, republication, downloading, display, screenshotting, uploading, or transmission of the material made available on the website permitted, nor the sale or assignment of the use of the website, without the prior express and written consent of Biorganic. This does not prevent users from using the present website to the extent necessary to create a copy of an order or of the contract details.
• You acknowledge and agree that any third-party information that may be presented to you through the website is protected by copyright, trademarks, service marks, patents, or other proprietary rights and laws. Your use of third-party software or content obtained through Biorganic does not transfer to you any rights, title, or interest. Furthermore, you agree that you will not use any third-party software or content made available to you through the website except as expressly permitted under the terms of use or license agreement of the third party. If you do not agree with the terms of use or license agreement of third parties, do not download or use the third-party software or content.
• In the event of a breach of the terms regarding intellectual property, you must immediately delete any material obtained unlawfully.
21.Social Media Platforms.
We also maintain a presence on social media platforms such as Facebook and Instagram. Any services we provide through social media platforms, as well as all information shared, submitted, or offered by us via our social media accounts, are subject to these Terms, unless explicitly agreed otherwise in writing.
22.Links on the Website.
Our website may contain links to other websites and resources provided by third parties, solely for informational purposes. The content of such websites or resources is in no way under our control, and, therefore, we bear no responsibility for any loss or damage that may result from the use of such links.
23.Written Communication.
Applicable law requires that certain information or updates we send you be in written form. When you use our website, you agree that communication with us will primarily be electronic. We will communicate with you via email or provide information by posting announcements on our website. For contractual purposes, you agree to this electronic form of communication and acknowledge that all contracts, notices, information, and other announcements we provide electronically comply with any legal requirement under which such communication must be in writing. This provision does not affect your legal rights.
24.Informational Emails (Newsletters).
• From time to time, we send informational emails. This information is provided only if you choose to receive it and for as long as you wish.
• We bear no responsibility for the successful delivery of newsletters, although every possible effort is made in cooperation with ISPs (Internet Service Providers).
• Newsletters may end up in the spam folder, so please check regularly to ensure they are not being stored there.
• If you no longer wish to receive informational emails, you can unsubscribe from the list by clicking the relevant link included in the newsletter.
25.Limitation of Obligations and Liability.
• Our liability in relation to any product purchased by the user/customer from our website is limited to the amount of the purchase price of that specific product, unless explicitly stated otherwise in these Terms.
• We bear no liability to you or any third party for any changes to the services and/or prices.
• In the event that you are not the lawful holder of the credit/debit/prepaid or any other type of card used to purchase products from our online store, we bear no liability to the lawful holder of the credit/debit/prepaid or any other type of card used for any transaction with our website. If your unlawful behavior is revealed, your subscription and the services provided by us will be terminated immediately and without notice, without prejudice to our legal rights in this case.
• You agree that you are solely responsible for any charges that may apply for accessing and using the website.
• We do not guarantee that our services will be provided uninterrupted, secure, or free from delays or errors. The content of the website may contain inaccuracies and typographical errors for which we bear no responsibility.
• We do not guarantee that the quality of our services will meet your expectations, that any errors will be corrected, or that our services will be free from viruses or other harmful components.
• We bear no liability to users, partners, or any third parties deriving rights from them for any loss or damage (direct, indirect, consequential, financial, or of any other kind) arising from:

26.Force Majeure Events
• Biorganic shall not be held liable or responsible for any failure or delay in fulfilling any of its obligations under a contract that has been caused by force majeure events.
• A force majeure event is considered any act, event, impossibility, omission, or accident beyond our reasonable control and includes, without limitation, the following:
a. Strikes, lockouts, or other industrial actions;
b. Social unrest, rebellion, invasion, terrorist attack or threat of terrorist attack, war (declared or not) or threat or preparation for war;
c. Fire, explosion, storm, flood, earthquake, subsidence, epidemic, or other natural disaster;
d. Inability to use railways, ships, airplanes, motor vehicles, or other public or private means of transport;
e. Inability to use public or private telecommunications networks;
f. Acts, decrees, laws, regulations, or governmental restrictions;
g. Any strike, damage, or accident affecting ferry, postal, or other transport services.
• The fulfillment of our obligations under any contract is considered suspended for the duration of the force majeure event, and the time for fulfilling our obligations will be extended for a period equal to the duration of such event. We will make every reasonable effort to bring the force majeure event to an end or to find a solution that allows the fulfillment of our obligations under the contract despite the force majeure event.
• We bear no responsibility for our products purchased from physical stores and not from our online store.
27.Transfer of rights and obligations.
The agreement between you and us is binding on both parties as well as on our respective successors and assignees. You may not transfer, assign, or otherwise dispose of the agreement, or any of your rights or obligations arising from it, without our prior written consent. We reserve the right to transfer, assign, subcontract, or otherwise dispose of the agreement, or any of our rights or obligations arising from it, at any time during the term of the agreement. For the avoidance of doubt, any such transfer, assignment, or other disposition does not affect your statutory consumer rights, nor does it cancel, reduce, or otherwise limit any express or implied warranty that we may have provided to you.
28.Indemnification.
You agree to assume responsibility in the event that any claim or demand is made against Biorganic by any third party, and to indemnify Biorganic for any expenses or losses, including reasonable legal fees (including, but not limited to, attorney’s fees), arising from:
a) your use of our website,
b) the sharing of any content resulting from your use of the website with any third party,
c) the use of any content you download from our website on your computer and/or servers by you or any other person to whom the information is provided,
d) any breach of these Terms,
e) any information you have sent, submitted, received electronically, displayed, printed, uploaded, or transmitted through the website, or
f) any violation of the rights of any other individual or entity.
You are responsible for your actions when using our website, including, without limitation, any costs incurred for Internet access. In all cases, Biorganic shall have the right to select its own legal counsel.
29.Additional Terms.
• Our failure to enforce any provision of these Terms shall not constitute a waiver of our right to do so later.
• If any provision of these Terms is found to be unenforceable, it shall be replaced with a valid provision, while the remaining provisions shall remain in full force and effect.
• These Terms were originally drafted in the Greek language and may be translated into other languages. In the event of any conflict between a translated version and the original Greek, the Greek version shall prevail.
• These Terms do not apply to the purchase of our products from physical stores. Such stores are not affiliated with our online store and are subject to different terms and policies.
30.Modification of Terms.
• These Terms, together with any other document expressly referred to herein, constitute the entire agreement between Biorganic and the users regarding the subject matter of each contract, superseding any prior written or oral agreement, understanding, or arrangement between us.
• We reserve the right to unilaterally modify, update, or remove any term contained in these Terms at any time and without prior notice to users.
• Users will be informed of any modifications and changes through the website of this online store or as otherwise required by law. It is clarified that changes to the Terms do not apply to orders that you have already placed.
• It is clarified that any modifications to the Terms shall not apply retroactively, but from the date they are posted on the website. By continuing to use the website after any modification takes effect, you agree to be bound by the new Terms. If you disagree with the changes, you may choose not to use the website.

Any dispute arising from or relating to the use of the website or such contracts shall be subject to the exclusive jurisdiction of the Greek courts, specifically those of Thessaloniki.
